TERMS AND CONDITIONS YOUR CONTRACT
Your Contract is with Dart Harbour Sea School Ltd.
- Provisional Booking and Deposit
A verbal or written booking will be held for 7 days only. Clients will need to confirm their booking by sending a deposit of 25% of the course fee, if the course is over 6 weeks away or for the full amount if the course takes place within six weeks.
- Confirmation
DHSS Ltd. will confirm the booking, in writing, within 5 days of receiving the deposit/full payment.
- Payment
Should you book less than six weeks before your course, we require the full amount to be paid.
The balance of the course fee is due six weeks prior to the start of the course. The balance will be automatically deducted from any credit card details provided unless you advise to the contrary.
- Client Cancellation
If it is necessary to cancel the booking, this must be done in writing and will be effective from the date that it is received by Dart Harbour Sea School Ltd. The client will be liable for the full fee unless cancelled more than six weeks before the course in which case only the deposit is forfeited.
Dart Harbour Sea School Ltd. will make every endeavour to sell the place and if successful will refund the client's payment, minus a £60 handling charge.
- Cancellation by Dart Harbour Sea School Ltd
DHSS Ltd. reserves the right to cancel the booking at any time and will refund the customer all sums already paid. DHSS Ltd. will also pay £20 compensation if the course is cancelled more than two weeks prior to the start date.
- Dart Harbour Sea School Ltd's Obligations
We undertake to pay all running expenses including harbour and port dues, pilotage fees, fuel, and gas. We also try, to the best of our endeavours, to fulfil the programme as discussed. However DHSS Ltd. is not liable should conditions beyond our control, eg weather conditions, not make this possible.
- Under 18's
Where a crew is not made up in total of one family or those known to each, we will only accept children of 14 years and above.
- Sea time
Every attempt will be made to give pupils maximum sea time. However, if the instructor's opinion, weather conditions, safety or any other consideration renders it imprudent, the instructor's decision is final.
- Vessel Change
If the school changes vessels, due to any vessel becoming unsuitable, for any reason whatsoever, this in no way affects the validity of the booking and the Terms and Conditions stated herein remain good.
- School Insurance
The school is insured for instruction. However students' needs vary. The school advises students obtain their own insurance for sickness illness, school fees, illness or accident onboard, or for any other reason the student considers prudent for his personal life style or well being. The student agrees the school insurance policies are adequate and the policy is available, on request, for inspection.
- Disclaimer
No liability is accepted for any student while on school grounds, in any of the school's properties, on ladders, pontoons or vessels and all students participate in any aspect of any course at their own risk.
- Breakages or Damages
Any breakages or damage must immediately be notified to the instructor or a member of staff for safety. A student shall be liable for any loss or damage to school or vessel's equipment, up to and including the first £100 per item.
- RYA Certificates
The school's standards of instruction are high and certificates will only be issued at the end of the course if, in the opinion of the school's instructors and principal, the student has reached the necessary standard. The school's decision shall be final and accepted by all students.
- Smoking
DHSS Ltd. operates a non smoking policy in its office premises and on its boats.
- Termination and Repossession
Should it come to Dart Harbour Sea School 's attention that a guest is likely to commit a serious breach of any of these conditions, DHSS Ltd. may forthwith terminate the agreement and take whatever steps necessary to remove the guest from the vessel.
Such termination and the taking of the possession shall be without prejudice to any rights and remedies, which may have accrued to DHSS Ltd. prior to the date of or by reason of such breach. DHSS Ltd. shall, in these circumstances have no liability for the unexpired part of the course.
- Dispute
In the event of a dispute not being settled by mutual agreement, it is agreed that the President of the British Law Society shall elect an Arbitrator whose decision shall be final. It is further agreed all agreements shall be governed by British Law, even when the dispute occurs outside British territorial waters.
